Terms of Use
Effective Date: September 3, 2026
These Terms of Use ("Terms") govern your use of The Guilty Party KC website, Character Portal, digital game materials, and related online services (collectively, the "Services") provided by The Guilty Party LLC ("The Guilty Party KC," "we," "us," or "our").
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Eligibility
You must be at least 13 years old to use the Character Portal. If you are under the age of legal majority where you live, you may use the Services only with the permission and supervision of a parent or legal guardian. Event-specific age requirements may also apply.
Character Portal Access
A Character Portal link or access token is personal to the assigned participant. It may reveal private character information and may allow actions to be submitted for an event. You agree to:
- Use only the portal and character assignment provided to you.
- Keep your access link and token confidential and not forward, publish, or share them.
- Notify us promptly if you believe your link has been lost, shared, or used without permission.
- Not impersonate another participant or attempt to access another participant's materials.
We may replace a link, reassign a character, restrict access, or revoke portal access when reasonably necessary to operate or protect an event.
Confidential Materials and Spoilers
Character dossiers, secrets, objectives, clues, solutions, reveals, scripts, plots, and other nonpublic game materials are confidential until we or the event host reveal them as part of the game. Do not copy, screenshot, record, post, publish, distribute, resell, or otherwise disclose those materials unless we expressly authorize it.
You may discuss and use the information during your assigned event as directed by the game and its host. Please avoid spoilers that could undermine another participant's experience or a future performance.
Fair Play and Participant Conduct
You agree not to:
- Manipulate votes, awards, results, event state, or another participant's submissions.
- Bypass access controls, probe for vulnerabilities, scrape the Services, introduce malicious code, or disrupt operation of the Services.
- Use the Services to harass, threaten, discriminate against, or unlawfully harm another person.
- Use portal content or event materials for a commercial purpose without our written permission.
Hosts may control the timing of phases, clues, voting, and results. Host decisions made to preserve safety, timing, or fair play are final for that event.
Gameplay Data and Browser Storage
The Character Portal may process your assignment, event status, task progress, votes, award selections, and results. It may use local storage or session storage on your device to remember progress and interface state. You authorize us to use submissions you make through the portal as reasonably necessary to run, score, and conclude your event.
For more information, see our Privacy Policy.
Fictional Entertainment
Our games are fictional entertainment and may include simulated crime, murder, deception, weapons, or other mature themes. Characters and story events are not statements about the real people portraying them. Follow host instructions, venue rules, and applicable law, and do not bring real weapons or unsafe props to an event.
Our Content and Limited License
The Services and their original text, artwork, graphics, audiovisual material, game expression, software, and branding are owned by or licensed to The Guilty Party KC and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, nonexclusive, nontransferable license to use the Services and your assigned materials solely for personal participation in the applicable event.
No other rights are granted. All rights not expressly granted are reserved.
Events, Tickets, and Separate Agreements
Event details, availability, pricing, venue rules, cancellation terms, and refund terms may be provided on an event listing, ticketing platform, proposal, or booking agreement. Those event-specific terms also apply. A liability waiver, photo release, or other agreement presented separately remains separate from these Terms and controls the subject it covers.
Third-Party Services and Links
The Services may link to ticketing, venue, payment, map, social-media, or other third-party services. We do not control those services, and their terms and privacy policies apply to your use of them. A link does not imply that we endorse every statement or service on the linked site.
Service Availability and Disclaimers
We may update, suspend, or discontinue any part of the Services. Portal availability, real-time updates, and digital materials may occasionally be delayed or interrupted. To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of uninterrupted availability, error-free operation, or fitness for a particular purpose. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
Limitation of Liability
To the fullest extent permitted by law, The Guilty Party KC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the Services. Our aggregate liability for claims arising from the Services will not exceed the amount you paid us for the event or service giving rise to the claim. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
Termination
You may stop using the Services at any time. We may suspend or terminate access when we reasonably believe these Terms have been violated or access creates a security, safety, legal, or fair-play risk. Provisions that by their nature should survive termination, including ownership, confidentiality, disclaimers, and liability limitations, will survive.
Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms with a new effective date. When a material update applies to the Character Portal, we may ask you to review and accept the updated Terms before continuing.
General Terms
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our written consent. These Terms, together with the Privacy Policy and any applicable event-specific agreement, are the complete agreement concerning your use of the Services.
